 Any use of www.theritestore.com (and/or other websites owned by RUSFRAJ d.o.o.) is subject to the following terms and conditions: documents, information and content published on the www.theritestore.com website (and/or other websites owned by RUSFRAJ d.o.o.) may not be copied, except for individual use and non-commercial purposes, always respecting copyright and other intellectual property rights, as well as any other restrictions on rights. Any copying, reproduction or distribution of documents, information and content from this website is permitted only with the prior consent of RUSFRAJ d.o.o.

 2. PURCHASE TERMS

 These purchase terms define the procedure for ordering, paying, delivering and complaining of goods offered at THE RITE STORE webshop. The seller of products at THE RITE STORE webshop is RUSFRAJ d.o.o., and the buyer of goods is a consumer, i.e. a person who orders and pays for any product outside of any activity through the seller’s webshop services, as well as other buyers who purchase products unrelated to their business activities. The seller sells via the Internet store THE RITE STORE, available at www.theritestore.com, on his own behalf. Purchase terms form part of the contract concluded remotely together with the specifications and price of the purchased product, and before confirming the purchase order for a particular product, the buyer will be required to accept or declare that they are known to or agree with them, while after confirming the purchase (conclusion of the contract), they will be delivered to the buyer as the content of an e-mail confirming that the contract was concluded. When the customer confirms and executes the order by paying, the contract has been concluded, and the seller will immediately notify the customer by e-mail that the contract has been concluded. In the event of a systemic error, RUSFRAJ d.o.o. is not obliged to carry out the incorrect order and deliver the product. Please note in particular that the purchase of products on behalf of minors or commercially incompetent persons can only be requested by their legal representatives, i.e., partially commercially competent persons can only request the purchase of products with the consent of their legal representative.

 3. By visiting the site of THE RITE STORE, you communicate electronically. By doing so, you accept that all agreements, notices, communications and other content submitted to you electronically meet the legal framework as if they had been delivered in writing. By choosing the “sign in to the newsletter” option, you give us your consent to include you electronically in our marketing and other activities.

4. AVAILABILITY OF AN ONLINE STORE

 While THE RITE STORE tries to offer you the best possible service, RUSFRAJ d.o.o. cannot guarantee that the services will meet your needs. THE RITE STORE also cannot guarantee that the service will be error-free. If an error occurs, please sign it into the e-mail info@theritestore.com to remove it as quickly as possible. The services provided by the www.theritestore.com Internet store do not include the costs you incur using computer equipment and services to access our website. RUSFRAY d.o.o. is not liable for telephone costs or any other costs that may arise. RUSFRAJ d.o.o. does not assume any responsibility for any damage or viruses that may infect your computer, telecommunications equipment or other property caused or derived from your access, use or browsing of this website, including downloading any information or materials from this website. RUSFRAJ d.o.o. or any of their employees, directors, associates, or any party involved in the creation, production or transmission of this website will not be liable to you or anyone else for indirect, special, criminal, accidental or consequential damage (including, without limitation, those resulting from lost profits, lost data or business interruptions) arising from the use, inability to use or results of the use of this website. Any website associated with this website, or materials, information or services contained in any or all such websites, whether based on a warranty, contract, indemnity procedure or any other legal theory, and whether such damage is possible or not. Previous limitations on liability do not relate to the scope prohibited by law. Please contact local law for any such ban. In the event of any problems with this website or any content, you agree that your only solution is to stop using this website. In the event of a problem with the goods or services that you have purchased on or through this website, you agree, if any, to notify the manufacturer of such goods or the supplier of such services in accordance with the manufacturer’s or the supplier’s guarantee or to request the return of such a product or service in accordance with the provisions of these general terms and conditions.

 5. AMENDMENTS TO THE GENERAL CONDITIONS

 RUSFRAJ d.o.o. reserves the right to amend these conditions and rules and excludes its responsibility for the possible consequences of such amendments. Amendments to these conditions and rules will enter into force by publishing them at THE RITE STORE. Any changes will be applied to the use of www.theritestore.com pages.

 6. When registering at The Rite Store, you will be required to create a password that you must keep to yourself and not share with other people. You are responsible for all the actions and orders under your password. If you know or suspect that someone is using your password unauthorized, you must notify us by e-mail at info@theritestore.com. If there is any doubt that there is a security breach, RUSFRAJ d.o.o. has the right to ask you to change your password or to block your user account. RUSFRAJ d.o.o. reserves the right to suspend your user account at any time and to refuse to execute the order for any customer.

 7. Statement on Security

 We use WebPay Service for Internet Billing of Monri Payments d.o.o., which uses state-of-the-art anti-abuse technologies, such as the secure socket layer (SSL) security protocol, and other technologies and security procedures according to the highest standards. The exchange of sensitive data between the online payment system and card company authorization centers is done using a network that is completely protected from unauthorized access. Sensitive information about your credit card is delivered online directly to the authorization center.

8. REGISTRATION

 Every visitor has the possibility of registering. Registration at THE RITE STORE Internet store is necessary to allow visitors to collect and spend points. It also serves to track baskets during product searches and to store product data using the “wish list” and “profile” options. Visitors to THE RITE STORE Internet store will be able to shop regardless of registration. As a visitor to THE RITE STORE Internet store, you can choose not to register, but in that case, you will not be able to use certain functionalities of THE RITE STORE Internet store. In case you do not want to register, for the purchase as a guest, it is necessary to enter basic data as well as billing data. In case of registration on the site OF THE RITE STORE Internet store, please enter all changes to your personal data in a timely manner on your personal profile on the site OF THE RITE STORE Internet store in order to ensure the completeness, accuracy and up-to-dateness of your personal data in your further use of the Internet store. In case you request the cancellation of your registration at THE RITE STORE Internet store from RUSFRAJ d.o.o. via contact e-mail, RUSFRAJ d.o.o. commits to permanently remove all your personal data entered during registration from the site of THE RITE STORE Internet store. To register for a www.theritestore.com Internet store, you must be at least 18 years old. The buyer is responsible for the accuracy and completeness of the entered data when registering. No registration is required to buy on the www.theritestore.com page.

 9. THE ORDERING PROCESS

Ordering the goods is possible 24 hours a day, 7 days a week. Orders are processed from Monday to Saturday. In order to complete the order, the customer must fill out an electronic form with basic data for the collection and delivery of the desired products and will be notified by email of the executed order. The customer selects the goods from the catalog of THE RITE STORE Internet store, which is complex according to the program (fragrances, skincare, make-up, body care, etc.), brand, price and other choices of THE RITE STORE Internet store. When choosing a product, you can click on its details to find out about it and get a better look at it, and if you want to buy it, you need to click on the “Add to Cart” link, and the desired product will be added to the cart immediately. In the basket, you can choose the quantities of products as well as cancel the purchase. Your cart is visible and available to you at any time, and you can continue to view our catalog. By placing the product in a basket, the product is not reserved, ordered, or purchased. Upon completion of the purchase, return to the basket and choose “Complete Purchase, after which it will be redirected to the page where the customer is required to enter their personal data, with the data marked with a red asterisk necessary for continuation. By clicking “Next step”, the customer opens a form in which it selects the payment method, after which the order confirmation is opened, indicating the latest overview of the order price and the selected payment method. It is necessary for the customer to mark the boxes “I agree with the purchase terms” and “I agree with the privacy policy,”, confirming that the customer has read and understood these general terms and privacy policy and agrees with them. Also, the buyer cannot complete the order without ticking the box “I am aware that the order includes a payment obligation”. If the customer agrees to buy the products in the cart, they can click on the pay icon. Once the customer fulfils the order, the seller will send the order confirmation, general terms, and privacy policy to the customer’s e-mail address, confirming that the customer’s order has been received and is in the process of processing. The seller will send the buyer to his e-mail address a confirmation of the concluded purchase agreement upon payment, together with a confirmation that the package has been sent. RUSFRAJ d.o.o. undertakes to deliver all ordered products that it has in stock at the time of delivery. Only products indicated in the order as being available may be the subject of the order. Due to the large number of orders placed at the same time on www.theritestore.com, information on the availability of the product may not be identical to the situation in the warehouse. If the ordered product is not available at the warehouse, the seller will inform the customer that the product is currently not available, within which time the product will be available, and at the same time offer the possibility to purchase an alternative product from www.theritestore.com that is available for delivery and which, by its characteristics, is closest to the product that cannot be delivered. The order is considered received when the seller receives it electronically and informs the buyer (order confirmation) by electronic means (e-mail).

 10. PAYMENT OF GOODS

The buyer undertakes to pay the ordered products with delivery costs to the Seller RUSFRAJ d.o.o. by one of the following payment methods: by accepting the order in cash when taking over the package by the carrier; by wire transaction (a general payment slip); or by credit card (Diners, Mastercard, Maestro, Visa Premium, Visa – for orders above 150 EUR you can choose to pay in 2–6 installments, and the cost of delivery is additionally charged in the price per price list published on the website of the store if the conditions for free delivery are not met. The purchase and sale contract was concluded at the time of payment. In the case of payment by virgin or general payment, the contract is considered concluded at the moment when the seller receives confirmation that the order amount has been paid and will, until the receipt of confirmation that the order amount has been paid, book/reserve the ordered products for 2 (two) working days. If the client chooses to pay the order in cash when taking over the package by the carrier, you will pay your order in cash to an employee of the courier service when taking over the goods. If you pay with a credit card, your data is protected by the Web Pay system, operated by Monri Payments d.o.o. This means that neither THE RITE STORE Internet Store nor Monri Payments d.o.o. have any insight into your card number; only the credit card company, the credit card holder, has it. Webpay is an online credit card authorization service via the Internet with maximum security. WebPay offers a secure connection to card company authorization centers and authorization of the four strongest credit cards in the state of Croatia (Visa Premium, Maestro, Diners, Mastercard and Visa). Special system security protocols protect all the data of all participants in the online purchase process.

 11. RUSFRAJ d.o.o. will try to ensure the maximum accuracy of the information on this Internet store, but it completely renounces any responsibility for the accuracy and/or completeness of all information and content on www.theritestore.com. The photos of the product are illustrative in nature, and we do not guarantee that they fully match the product itself. The visual identity of the product shown in the photograph does not have to correspond to the appearance of the product in reality, especially given the display settings on the customer’s computer, differences in color perception as the customer sees them on the screen, etc. In the event of the abovementioned discrepancy between the product shown in the photograph and the product supplied, there is no shortage of the product. We are not responsible for any unintended errors in the product description. Differences may be made between the actual product and the product described on these pages if the manufacturer modifies any of the characteristics or composition of the product. All descriptions will be checked regularly and in detail. Product data (product description, price, etc.) shown on the www.theritestore.com website are subject to bugs, malfunctions in the application, other technical irregularities, typographic errors, etc. In the event of systemic errors, manifest errors or malfunctions in relation to the product information displayed on www.theritestore.com, the seller reserves the right to terminate the contract unilaterally. The products on this website may be unavailable, have different attributes than those listed above, or have a price other than that shown on the website. We can also change the price and availability without prior notice. Confirmation of the order is not confirmation of our acceptance of the order or confirmation of the service and sale of the product. We reserve the right, without prior notice, to limit the quantity of the order to any product or service and/or refuse the service to any customer. Any possible price errors are subject to correction. We reserve the right to refuse any order if there is a price error shown on our website. We can also request confirmation of the data before accepting and/or dispatching any order. All goods and services purchased on or through this website are subject only to valid guarantees from their manufacturers. To the maximum extent permitted by the applicable law, we hereby waive all guarantees of any kind, whether explicit or implied, including implied guarantees relating to the goods and services listed or purchased on or via this website. Without limiting ourselves to the generality of the former, we explicitly waive any liability for product defects or malfunctions resulting from normal wear, product abuse, misuse, product modification, incorrect product selection, non-compliance with any codes, or unauthorized misappropriation. All prices are denominated in the Croatian national currency, the euro (EUR), with VAT and relate to purchases via online shops. Prominent prices are valid for all payment methods, and payment can only be made in euros.

 12. INTELLECTUAL PROPERTY

The content of the www.theritestore.com online store represents the copyright of RUSFRAJ d.o.o., and RUSFRAJ d.o.o. exercises a unique right to use it. For any commercial use of the content on the www.theritestore.com site, you must contact RUSFRAJ d.o.o. at the email address info@theritestore.com. Trademarks, trade names, service marks and logos used or displayed on this website are registered and unregistered trademarks, trade names and trademarks of THE RITE STORE and other owners. Nothing contained on this website shall be given or interpreted as giving an implied, estoppel or otherwise licensed or entitled to use trademarks, trade names, service marks or logos displayed on this website without written approval by Rusfraj d.o.o. or another owner. The Rite Store’s Internet store may contain links to websites that are not owned, managed or controlled by www.theritestore.com. All such relationships are listed only as a convenience to you. If you use these links, you will leave the website, and RUSFRAJ d.o.o. is not responsible for any content, materials or other information that is on or accessible from any other website, and you access any other site at your own risk. It shall be prohibited to place or transmit any illegal, threatening, defamatory, obscene, pornographic or indecent material or any material that could constitute or encourage conduct that would be considered a criminal offense, cause civil liability or otherwise infringe any law.

 13. RETURN OR COMPLAIN OF GOODS

The Rite Store Internet store operates in accordance with the Consumer Protection Act and other applicable laws and regulations of the Republic of Croatia. The buyer is responsible for any use of the product for a purpose that is not in accordance with their intended purpose, and RUSFRAJ d.o.o. does not bear any responsibility for the use of the purchased products, and any use will be at its own risk. Before buying and using any product from The Rite Store’s Internet store, carefully read all instructions, labels, and ingredient lists and follow the appropriate instructions for use. If you are not sure that your skin is compatible with the ingredients, talk to your dermatologist or doctor before buying or using any of the products. When receiving the goods, the buyer is obliged to check the correct order, compare the received items with the invoice, and, if something is missing, immediately mention it to the delivery person. In the event that the buyer orders the goods and refuses to accept them, the seller has the right to ask the buyer for reimbursement of postal and handling costs.

 • UNILATERAL TERMINATION OF THE PURCHASE AND SALE CONTRACT

The buyer has the right, without mentioning the reason, to terminate the purchase and sale contract within 14 days from the day of taking over the goods. The buyer does not have the right to unilaterally terminate the contract, i.e., to return the purchased product within 14 days if the object of the purchase is sealed goods that, for health or hygiene reasons, are not suitable for return and which were unsealed after delivery. The prerequisite for unilateral termination of the contract is that the goods have not been used and are contained in the original packaging. For a product that has been unsealed or used, the seller shall not be required to refund the funds. For the product that is damaged and the one that does not have a warranty and all related documentation that was in the product after the buyer took it over, the seller is not obliged to take it back and is not obliged to refund the paid purchase price. In order to exercise the right to unilateral termination, the buyer must, before the expiry of the stated deadline, mail to the trader in RUSFRAJ d.o.o., Donja Stubica, Toplička 64 or e-mail  info@theritestore.com a notification stating that it terminates the contract either by means of a unilateral termination form or by means of any unambiguous statement expressing its intention to terminate the contract. A confirmation of receipt of the notification of unilateral termination of the contract will be delivered to you, without delay, by e-mail. You can download the unilateral termination form HERE, and the text is the following: Notification of unilateral termination of the contract I, _________________________________________________ (consumer name and surname) from ___________________________________________ (consumer address: place, street, number) hereby declare that I unilaterally terminate the contract to purchase the following goods or services: ______________________________________________________________ (enter the name of the item) by account number or order number ____________________________ (enter the document number) received on _________________________ (city/place) on _____________________. (date). ________________________________ consumer signature (only if this form is completed on paper). The buyer must send the contract termination statement or form with the original invoice before the expiration of the deadline for the termination of the contract. In the event of termination of the contract, each party shall return to the other what it has received under the contract. The buyer shall return the goods received without delay and no later than 14 days after informing the seller of his decision to terminate the contract. If the buyer exercises his right to unilateral termination of the contract, the buyer shall bear the cost of returning the goods and shall bear the cost of any impairment of the goods. The seller shall refund the money only after receiving returned products or confirmation from the buyer that they have been sent to the seller within 14 days.

 • COMPLAINTS OF DEFECTIVE GOODS

The buyer has the right to return or exchange the goods in the following cases:

• delivery of goods that have not been ordered
• delivery of goods that have expired
• delivery of goods that have defects or defects that have not occurred in transport point 10. In the Consumer Protection Act, we enable the customer to send complaints to the e-mail address info@theritestore.com or via mail to the address RUSFRAJ d.o.o., Toplička cesta 64, Donja Stubica. We will respond to all complaints received as soon as possible and no later than 15 days from the date of receipt of the complaint. The return in the case of a complaint of defective goods shall be effected by sending a delivery service to the customer to collect the package upon receipt of the complaint, in agreement with the customer. The complaint will be considered valid if the product review and possible expert opinion show that it corresponds to the conditions for the complaint in accordance with the Act on Obligatory Relations and the Consumer Protection Act. If the complaint is valid, at our expense, we will exchange the goods for identical ones without defects or refund the entire amount paid for the product. If the complaint is not valid, i.e., if the consumer’s complaint is rejected, the complaining buyer will bear the cost of re-delivering the purchased product to the customer’s address. In the event of an inability to deliver other goods, THE RITE STORE will reimburse the customer for the costs of returning the goods and the value of the goods that cannot be delivered. The seller does not answer to the buyer or recipient for minor scratches on products and packaging defects resulting from the delivery of goods through the delivery service if scratches, packaging defects, or other minor defects do not affect the basic characteristics and usability of the product.

 • RESPONSIBILITY FOR MATERIAL DEFECTS: liability for material defects will apply under the provisions of the Mandatory Relations Act. If the customer is a legal person, the consumer protection rules do not apply to him, but the relevant provisions of the Mandatory Relations Act and the e-Commerce Act apply. In the event of a possible dispute, RUSFRAJ d.o.o. and the consumer will try to resolve the dispute peacefully, and if that is not possible, the court in the Republic of Croatia with the application of Croatian law has jurisdiction. Dispute resolution is possible in mediation proceedings before mediation centers. 

14. Postage and shipping are delivered through GLS and are available on the entire territory of the Republic of Croatia, and delivery for territory outside the Republic of Croatia is done through DHL and GLS. The delivery price shall be calculated in the amount indicated below and shall be indicated in the cart review before payment is made. For orders in the amount of more than _150 _ EUR, the delivery price in the territory of the Republic of Croatia is free of charge. For shipments with a total order value (shipped to the territory of Croatia) that is less than EUR 150, the shipping costs are charged 5 euros per order. The ordered goods will be arranged in such a way that normal manipulation during transport cannot damage them. When accepting the ordered goods, the buyer is obliged to check for any damage, immediately advertise it to the delivery worker who delivered the goods, and refuse to take over the delivered goods showing external damage. The verification of the correct order depends on the customer, and subsequent complaints are not respected. RUSFRAJ d.o.o. is not responsible if the customer did not enter the delivery address correctly and therefore the package did not arrive at the destination. It is the responsibility of the buyer to provide information on the delivery address and any additional details related to the delivery (for example, additional descriptions of the delivery address if the destination is not completely clear from the address). In the absence of such information, the seller will organize the delivery of the goods in the best way possible, but will not accept any responsibility regarding the delivery deadline or delivery risks. In case you are not present at the delivery address, it is your responsibility to take the package from the delivery service place within the time period specified by the delivery service or to arrange a new delivery if the engaged delivery service allows such a choice. We will deliver your products as soon as possible. Products are packaged and sent to your address, as a rule, within 24 hours of the moment of ordering. If there are too many orders, we kindly ask for your understanding as the delivery process of your package could be extended.

 Note: The Rite store does not take responsibility for the additional fees when receiving the product. Please check with the delivery services within your country about possible, additional shipping and import fees that may occur when purchasing products from countries outside of the Republic of Croatia. Our prices do not include local taxes, import fees or other additional fees that may be charged to you when you receive the shipment. Kindly keep in mind any additional fees that may be charged to you. When your products arrive, we won’t be able to pay you back if you change your mind. If you have not earned the right to free delivery (free delivery is possible for the territory of the Republic of Croatia – for orders above 150 euros) we charge for delivery according to the standard prices from the DHL and GLS

 15. LOYALTY PROGRAM

Customers are allowed to join the loyalty program THE RITE STORE by opening a user account through which they will collect points by buying through the Internet store THE RITE STORE and buying in THE RITE STORE. When opening a user account, customers will choose a username and password and will provide their email address and date of birth. The Rite Store does not have access to the customer’s password. In order to be able to join the loyalty program, it is also necessary to mark it as “like” or “follow” (“follow”) on THE RITE STORE page on Facebook and Instagram. By joining the loyalty program and accepting these General terms and conditions and Privacy policy, customers agree to the processing of their personal data and to the processing of data pertaining to their executed orders via a webshop or purchases in THE RITE STORE.

Customers participating in the loyalty program will collect points through their user account by shopping in THE RITE STORE and shopping on the RITE STORE website, and depending on the status of SILVER, GOLD, PLATINUM or DIAMOND/PRIVATE CLIENT, they will have certain benefits when purchasing.

A customer who has joined the loyalty program immediately gets “Silver” status and can obtain a 10% discount on the first order and free delivery on the second order (valid only for customers from the territory of the Republic of Croatia).

A customer who spends EUR 1000 after being included in the loyalty program achieves GOLD status and can obtain benefits that include a BIRTHDAY GIFT (10% discount on purchase) and special discounts and offers.

The buyer who, after joining the loyalty program, spends EUR 2500-5000, achieves PLATINUM status and can obtain benefits that include 1 OF THE RITE APPOINTMENT (in THE RITE STORE), a birthday gift (10% discount on purchase), and other special discounts and offers.

The buyer who, after joining the loyalty program, spends EUR 5000–10000 achieves Diamond status and can obtain benefits that include 2 OF THE RITE APPOINTMENTS per year (in THE RITE STORE), a birthday gift (10% discount on purchase), the benefit BE THE FIRST TO TRY, an event invitation, and other special discounts and offers.

A customer who, after joining the loyalty program, spends more than EUR 12000, achieves PRIVATE CLIENT status and can benefit from 1 OF THE RITE APPOINTMENT per month (in THE RITE STORE), BIRTHDAY GIFT (10% discount on purchase), BE THE FIRST TO TRY, EVENT INVITATION, free shipping and gift wrapping, priority customer support and other special discounts and offers.

16. By accepting these purchase terms, the buyer agrees to their terms and accepts that they form an integral part of the contract. By confirming the order, the buyer confirms that he has read the General terms and conditions, agrees with them and that they form an integral part of the Purchase agreement.
